   The day I was hoping would never come has arrived.

   I have suspended pawoo.net for users posting child porn, and no admin action has been taken despite repeated requests.

   I know some of you oppose suspensions, but I have to take actions to protect us.

   Merely having cached images from this instance could be a legal liability in the USA. In this hostile legal climate, I would prefer to err on the side of caution.

   I sincerely apologise for needing to perform this drastic step.

     If you have ANY users following ANYONE from this instance, at THE MINIMUM, purge your image caches IMMEDIATELY.

     You are opening yourself to severe legal liability if you do not.

     Safe harbour provisions have been ruled not to apply to moderated forums.

     This legal climate is far too hostile not to take precautions.

     @Elizafox hi Elizabeth: I work for the EFF, though I'm not a lawyer, and this isn't legal advice, and more of a question. Do you remember where you got the idea that the CDA 230 safe harbor doesn't apply to moderated content? It was originally drafted specifically to permit moderation by hosts, so that interpretation surprises me.

     (Note that this isn't about CP, or simulated CP which -- because of the potential for criminal prosecution -- is covered by different laws.)

     This may be a problem in Sweden however, see the so-called Manga case. In that particular case only one picture was deemed to be child porn, but the guy got off partly for being a huge weeb

     @chr lolicon isn't illegal in the US, although many find it disgusting. if you're talking about photographic CP, however, then freaking out is warranted.

     @Elizafox @chr @sonya it's maybe less an issue for the Americans, but it is illegal in Sweden & Germany & France. Not sure if it's EU-wide.
