   No, "could" is the wrong word. If the reasoning in NFIB v. Sebellius means anything then the legality of the whole mess is tied to the taxing power. If there is no longer any connection to the taxing power then frankly there is a rather stark gap in terms of constitutional warrant for the federal government providing health care without passage of another constitutional amendment.
